Terms of Service

These Terms of Service ("Terms") govern your access to the MyAthlete Data Integrity & Performance Engine. By using our Service, you agree to these Terms. If you are using the Service on behalf of a Swimming Club, you represent that you have the authority to bind that Club to these Terms.
1. The Professional Service Model
MyAthlete provides a high-integrity Operating System (OS) for competitive swimming. Our Service utilizes Atomic Ingestion and Self-Healing Database logic to ensure data purity. While we provide the infrastructure, the Club remains the owner of the data and the primary administrator of its rules.
2. Financial Operating System & Payments
Our Finance Engine handles complex billing logic, including batching and "Virtual Wallets."
- Third-Party Processing: Payments are processed via Mollie B.V.. By using the finance features, you agree to Mollie’s terms of service.
- SEPA Direct Debit: By confirming a payment mandate, you authorize MyAthlete (via Mollie) to send instructions to your bank to debit your account. You are entitled to a refund from your bank under the terms and conditions of your agreement with your bank. A refund must be claimed within 8 weeks starting from the date on which your account was debited.
- Pre-notification: You agree to a reduced pre-notification period of 3 days for all recurring SEPA Direct Debit collections.
- Immutability: To maintain audit trails, financial entries in MyAthlete are "Double-Entry" and immutable. Errors must be corrected via Credit Notes or Voids.
- Liability: MyAthlete is not responsible for bank fees, overdrafts, or failed mandates resulting from Club-initiated billing runs.
3. Subscription Fees & Pricing
MyAthlete is a Software-as-a-Service (SaaS) platform billed to the Swimming Club.
- Club Subscription: Standard club access is billed at €800.00 per year (unless otherwise agreed in a specific Service Level Agreement).
- Financial Engine Service Fees: To cover the costs of maintaining the Intelligent Batching and Temporal Ledger infrastructure, a fixed service fee is applied to each transaction processed:
- €0.25 for transactions with a total value below €65.00.
- €0.50 for transactions with a total value of €65.00 or above.
- Billing Cycle: Subscriptions are billed annually in advance. Payment is due within 14 days of the invoice date.
4. Data Integrity & Self-Healing
To eliminate "Data Debt," MyAthlete employs asynchronous scripts to merge duplicate records and heal historical data.
- Probabilistic Matching: You acknowledge that the system may automatically merge records based on Name, DOB, and Club History.
- Atomic Rollbacks: We reserve the right to roll back data imports that fail structural validation at the API level.
5. Competition & Entry Management
- Verification: Every entry is a "Living Link" to a database result. MyAthlete does not guarantee that a "Verified" time will be accepted by a third-party meet host.
- Manual SD3 Exports: The Club is solely responsible for the manual download and transmission of entry files.
6. Governance & Compliance
- Professional Responsibility: The platform tracks credential expiry. It is the user's responsibility to ensure qualifications are current.
- Medical Information: Emergency medical data is provided for Club use. MyAthlete is a storage provider and does not provide medical monitoring.
7. Cancellation & Refunds
- Club Subscription: Clubs may cancel their subscription at any time. Cancellation will take effect at the end of the current paid billing period. No pro-rated refunds are provided for mid-term cancellations.
- Club-Specific Payments: Refunds for Gala entries, Kit, or Squad fees are managed by the Club Treasurer. Approved refunds are issued as store credit to the Family Virtual Wallet or returned via the original payment method at the Club's discretion.
8. Legal Identity

9. Disclaimers & Limits
- AI Accuracy: "Predict AI" trajectories are statistical models and are not a guarantee of future performance.
- Service Availability: While we strive for 99.9% uptime, we are not liable for losses during temporary downtime.
10. Governing Law
These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
