Terms of Service

These Terms of Service ("Terms") govern your access to the MyAthlete Data Integrity & Performance Engine. By using our Service, you agree to these Terms. If you are using the Service on behalf of a Swimming Club, you represent that you have the authority to bind that Club to these Terms.
1. The Professional Service Model
MyAthlete provides a high-integrity Operating System (OS) for competitive swimming. Our Service utilizes Atomic Ingestion and Self-Healing Database logic to ensure data purity. While we provide the infrastructure, the Club remains the owner of the data and the primary administrator of its rules.
2. Financial Operating System & Payments
Our Finance Engine handles complex billing logic, including batching and "Virtual Wallets."
- Third-Party Processing: Payments are processed via Mollie B.V.. By using the finance features, you agree to Mollie’s terms of service.
- Immutability: To maintain audit trails, financial entries in MyAthlete are "Double-Entry" and immutable. Errors must be corrected via Credit Notes or Voids; original records cannot be deleted.
- The "Rule Sandbox": Pricing simulations and pro-rating calculations are estimates for administrative guidance. The Club Treasurer is responsible for final verification of all charges before collection.
- Liability: MyAthlete is not responsible for bank fees, overdrafts, or failed mandates resulting from Club-initiated billing runs.
3. Data Integrity & Self-Healing
To eliminate "Data Debt," MyAthlete employs asynchronous scripts to merge duplicate records and heal historical data.
- Probabilistic Matching: You acknowledge that the system may automatically merge records based on Name, DOB, and Club History. Users are responsible for reporting any incorrect merges to their Club Admin.
- Atomic Rollbacks: We reserve the right to roll back data imports (e.g., Hytek or SD3 files) that are corrupted or fail structural validation at the API level.
4. Competition & Entry Management
- Verification: Every entry is a "Living Link" to a database result. MyAthlete does not guarantee that a "Verified" time will be accepted by a third-party meet host.
- Manual SD3 Exports: MyAthlete provides the tool to generate entry files. The Club is solely responsible for the manual download, verification, and timely transmission of these files to meet hosts.
- Equivalent Time Algorithm: Conversions (SCM to LCM) are provided for seeding purposes based on industry-standard physics models but remain subject to the specific rules of the meet organizer.
5. Governance & Compliance
MyAthlete provides a "Digital Shield" for safeguarding and medical data.
- Professional Responsibility: The platform tracks credential expiry (e.g., Vetting/Lifeguarding). It is the individual user's responsibility to ensure their qualifications are legally current; MyAthlete is not liable for lapses in professional certification.
- Medical Information: Emergency medical data is provided by Parents/Athletes for use by the Club. MyAthlete is a storage provider and does not provide medical monitoring or alerts.
6. Disclaimers & Limits
- AI Accuracy: "Predict AI" trajectories are statistical models based on historical data. They are not a guarantee of future athletic performance or scholarship eligibility.
- Service Availability: While we strive for 99.9% uptime, we are not liable for any losses occurring during temporary downtime, especially during gala entry windows.
7. Governing Law
These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
